LAW505: Remedies
This unit examines the specific goals of judicial remedies in common law (tort and contract), equity, and pursuant to statutes such as the Trade Practices Act, and discusses the protection of public and private interests through the use of private remedies. Remedies has a strong practical focus on the specifics of damages, injunctions etc, whilst not losing sight of the broader issues and theoretical dimension. Issues considered include: tort reform and the changes to the common law of damages pursuant to the 'Civil Liability Act 2002' (NSW); gender issues in relation to compensation for the loss of domestic skills and discounting for re-marriage prospects; the limits on state coercion in civil matters; how contract and tort law inter-relate, and whether they are part of a coherent system of remedial law. This unit revises, consolidates and completes students' study of contract and tort, and is the only place in the compulsory curriculum in which contract and tort as well as common law and equity are comprehensively compared. Topics include: self-help remedies; compensation in tort, contract and equity; restitution; punitive damages; and coercive remedies (injunctions, specific performance).
