LAW203: Torts

This unit examines the law of torts from a practical and normative perspective, focusing on the relationship between social and legal change. Torts is an area of law which addresses the question of individual responsibility and social responsibility between members of a community. We examine the concepts of fault and responsibility, and begin to consider the aims, purposes and rationale of the law of torts. The main focus of the unit is on the law of negligence, the most significant of the modern torts. Judicial and legislative development of the law of negligence raises ethical, moral, philosophical, and political issues, which are explored in the context of studying the law. Other topics discussed include intentional torts, nuisance, concurrent liability, and defences.
