Advanced Torts stresses the dynamic nature of tort law and its capacity to respond to social change in a variety of ways. A primary focus is dignitary injury. Topics include: emerging torts and novel applications for existing torts (such as privacy, sexual injury including harassment and incest, Wilkinson v Downton); toxic torts (tobacco litigation, various pharmaceutical/therapeutic products including DES); mass tort claims/class actions; defamation; wrongful life and birth, pre-birth/pre-conception injury; educational malpractice; bullying in schools and workplaces. Students are expected to adopt a creative and critical perspective. Readings are drawn from Australia, Canada, the UK, New Zealand, USA, and other jurisdictions.
