Dispute Management and Resolution - LAW465
Dispute resolution schemes now dominate the practice of law at many levels. This unit explores various types of dispute resolution processes with an emphasis on negotiation, mediation, arbitration and restorative justice. The unit provides an overview of the theory, philosophy, process and legal issues involved in each of these methods of dispute resolution. Students are also encouraged to reflect on ethical issues involved in dispute resolution including dealing with power disparities between parties, the role of third party neutrals, the level of state control over the processes and the development and application of professional standards for dispute resolvers.
