Advanced Torts - LAW886

This unit gives students an opportunity to (i) explore topics which are not covered in basic Torts courses, such as defamation; (ii) take an in depth look at negligence in specific contexts eg medical malpractice (wrongful birth, wrongful life, pre-birth / preconception injury), and education (school bullying, sexual assault by teachers, educational malpractice); (iii) to examine emerging torts or novel applications for existing torts, eg privacy, sexual injury including harassment, Wilkinson v Downton; (iv) to explore toxic torts (tobacco litigation, various pharmaceutical/ therapeutic products) and mass tort claims/class actions. Readings are drawn from Australia, Canada, UK, NZ, USA, and elsewhere.
