LAW466: European Law and Institutions

Although this unit forms an introduction to the European Union and the European Court of Human Rights, it does a lot more than that. These organisations can be understood as part of globalisation. Our focus may be on Europe, but the issues we examine affect all peoples everywhere: human rights, the environment, international trade and the concept of national sovereignty. Throughout this unit we maintain very much an Australian perspective. Given that the EU is Australia's largest trading partner, how do European policies affect life on this side of the world? Do Australia's human rights and environmental records measure up to European standards? How will Europe's increasingly global involvement affect Australians' ability to decide their own affairs? A knowledge of EU law and the European Court of Human Rights is essential for anyone planning to study or practise law in Europe (including the UK). An exploration of the bizarre entity that is the EU will greatly enhance students' understanding of national and international law. By questioning some basic assumptions about law, this unit consolidates students' understanding of how any legal system operates.
