LAW461: Discrimination and the Law
This unit focuses on the role of law in discrimination, not only in Australia but internationally. We also consider law as a cause of, as well as a solution to, discrimination. We also look beyond the law, at the root causes of prejudice in society. Among the questions we ask is the meaning of discrimination, as well as that of equality. Why is it acceptable to discriminate on some grounds and not on others? For instance, why is discrimination in favour of clever people or against smokers acceptable, whereas discrimination on grounds of race or sex is not? Does evidence of differences in brain structure between males and females justify institutionalised distinctions between these groups? And when should a difference be regarded as a disability?
