LAW410: International Trade and Finance
The legal regime governing the international exchange of goods, services and capital is the subject matter of this unit. There is a close relationship between trade investment issues and monetary system. Settled monetary system is indispensable for the operation of trade policy effectively. The interaction of trade and monetary issues and the interplay of law, politics and diplomacy in regulating these issues are highlighted and commented upon. Topics to be considered in the tutorials include: the international legal framework for trade and financing; international trade and trade practices; limitation on jurisdiction; impact of national foreign and trade policies on international trading activities; trade as a political issue; international transaction of capital; the role of foreign investment in Australia; dispute resolution systems; and environmental aspects of international trade. The unit also considers the so called Singapore Issues, non-trade issues such as human rights, use of child labour and labour standards. Various World Trade Organisation (WTO) Ministerial Declarations and some recent developments in the post-Hong Kong Ministerial of 2005 are highlighted and commented upon. The WTO, which came into operation on 1 January 1995 is expected to achieve multilateral trade liberalisation for economic development. Its performance over the past 14 years is critically examined. The unit is likely to be most rewarding in appreciating diverse interests the world trading nations and dynamic horizons of international trade and finance in the 21st century.
