LAW857: Environmental Litigation and Mediation

This unit examines adversarial and consensual modes of dispute resolution in environmental contexts. The nature and scope of environmental disputes will be considered at both the international and domestic levels. The unit explores international approaches to, and institutions for, environmental dispute resolution. At the domestic level the administrative and judicial characteristics of the New South Wales Land and Environment Court provide a focus for analysis of the laws of evidence and procedure. Comparative approaches from other jurisdictions with respect to litigation and public participation will be discussed. Alternative dispute resolution, including mediation, is studied as a phenomenon and as a process in the environmental context.
